Red zone offenders ‘must expect jail’
A 30-year-old red zone burglar was sentenced to nine months prison and refused home detention in the Christchurch District Court today.
Judge Gary MacAskill said red zone offenders must expect imprisonment and with Jayden Andrew Marshall’s record of burglary he should have known better.
Defence counsel for Marshall, Margaret Smyth, said Marshall had a home detention address and asked that it be checked for suitability.
She said Marshall used to have an itinerant lifestyle and kept unsavoury company, but now had a stable home with good friends who were in full time work. Marshall was a sickness beneficiary, and was relieved with the change in his lifestyle as he was not happy previously.
Judge MacAskill said it was not Marshall’s first burglary, it was a burglary in the red zone, and Marshall had a long list of prior dishonesty offending.
He was not doing a community work sentence for a previous burglary, so he refused the adjournment to check the address.
Judge MacAskill said Marshall and two others had dismantled items including a heat pump, and piping.
The burglary was in a property in the area of Hulverstone Drive owned by the Canterbury Earthquake Recovery Authority.
Marshall had a substantial list of offending, and six breaches of community work charges, Judge MacAskill said, and he needed to pay the price for his current offending, and look forward to turning himself around upon release.
He sentenced him to nine months prison and said Marshall would still have to do his previous community work sentence when he was released.
