Costs awarded against police

Police-badge-2013-09-001The Commissioner of Police has been ordered to pay $300 costs to a young man because he was summoned to attend an incorrect session at the Christchurch District Court.

The costs award was made by Judge Christopher Somerville when the man appeared on a charge of careless driving causing injury.

The court was hearing departmental prosecutions but some police cases had been incorrectly sent to that session by police officers in charge of the cases.

Judge Somerville said he had heard 17 cases sent to the court incorrectly during the morning, inconveniencing many people, and when another one came up in the afternoon he took a stand.

He remanded the case without plea to next week and told the man: “The Commissioner of Police is going to be paying you $300 for taking the afternoon off work.”
