Deterrent imposed on red-handed red-zone burglar
A red-zone burglar caught with a tap he was stealing still in his hand, was sentenced to prison for four-and-a-half months.
Morgan Boyd McIntyre, 30, had already been in prison for six weeks waiting for the sentencing, but did not have a suitable address for home detention.
Defence counsel David Stringer said the burglary was driven by an addiction to cannabis or synthetic cannabis.
He said the police arrived at the Parish Street, Burwood, address and found him with a tap in his hand, so he didn’t get away with anything.
In the Christchurch District Court Judge Jane Farish said McIntyre had been remanded in custody as a deterrent for other people considering red-zone Cera buildings as fair game.
She said it was not just the loss to Cera, but the risk that the buildings may not be safe, and other people could be harmed in trying to get people out of them.
She said pernicious legal cannabis was far more addictive than normal cannabis.
McIntyre was sentenced to four months two weeks in prison, with release conditions for six months following to undertake treatment and counselling for substance abuse.
Judge Farish ordered the destruction of the tools used in the burglary.
