Trial hears of ‘rough sex’ agreement

Court House-07An agreement with a prostitute to have “rough sex” has been raised at the Christchurch trial of a man charged with kidnapping, rape, assault and sexual violation involving two sex workers.

The two women involved have been giving evidence to the High Court in Christchurch for the last two days.

On trial before Justice Rachel Dunningham and a jury of 11 is Daniel Juan Daly, 28, who denies 13 charges. He is charged with kidnapping, sexually violating, and twice assaulting one woman using a knife as a weapon. He is charged with kidnapping the other woman, assaulting her, five charges of sexually violating her, attempted sexual violation, and rape.

The charges relate to Daly having sex with two sex workers he met in central Christchurch on the night of January 24-25, 2013, when both women complained later of the rough treatment they had received.

Daly’s defence counsel Matt Dixon questioned the second woman about the discussion between her and Daly about rough sex before the incident took place in his room at the YMCA.

She accepted, “to an extent”, that she had agreed to rough sex. “But obviously, our definitions of rough sex are different,” she told the third day of the trial today.

She told the trial that she had agreed to the night’s sex with Daly for $1000, but next morning she had been paid only $250.

The trial is set for five days, and due to end on Friday.
