Jury retires in driving death case

Court House-Sept-2013-05The jury in the Cody Marcus John Pierce driving death trial retired at midday to consider its verdicts.

Christchurch District Court Judge Alistair Garland had spent the morning summing up the case for the jury on the fifth day of the trial.

Pierce denies three charges: two alternative charges alleging drink-driving was a factor in the October 2012 crash in which Sean Christopher Frost received fatal injuries, and a charge of failing to render assistance and leaving the scene of the crash.

Richard Maze appears for Pierce, a 23-year-old painter from Darfield, and Barnaby Hawes and Anselm Williams appear as Crown prosecutors.

The Crown alleged Pierce had been drinking at a party before driving and losing control of the vehicle on a bend near West Melton. The car crashed into a power pole, fatalling injuring the passenger.
