December 1 set for McGrath extradition review

Court House-general 3December 1 has been set for the hearing of a judicial review into the decision to extradite former Catholic brother Bernard Kevin McGrath to Australia to face hundreds of child sex abuse charges.

The review will be heard in the High Court in Christchurch after McGrath’s lawyer, Phillip Allan, filed papers seeking the review this week.

McGrath, 65, is challenging the decision of Justice Minister Judith Collins to grant his extradition, which was released on Monday. A Christchurch District Court judge decided last year that the extradition could go ahead but the case was referred to the minister in April for a final decision.

When the judicial review application was filed, interim matters were to be dealt with today, but Mr Allan said they had been resolved by consent yesterday, without a hearing.

It is understood that McGrath remains on bail.
