Man videoed his own sex offending on cellphone

Court House-Sept-2013-06A father-of-two who videoed himself as he sexually violated and raped a sleeping woman has been jailed for seven-and-a-half years.

Family was in tears as 38-year-old Ryan Alistair Garland was sentenced in the Christchurch District Court and taken to the cells.

Garland wiped away tears himself as he heard Judge Stephen O’Driscoll imposing the jail term after his guilty pleas.

Defence counsel Andrew Riches said Garland was remorseful and had written a letter of apology to the victim. He was willing to undergo any available treatment while serving his prison sentence.

He said the videoing had been done for Garland’s sexual gratification and not to humiliate or blackmail the victim.

Police found that video of the sex offending had been uploaded from Garland’s cellphone to his computer.

Judge O’Driscoll said there had been significant emotional consequences for the victim who now showed signs of post traumatic stress disorder.

He said she had been a vulnerable victim because she was asleep and he rejected the defence contention that there had been no premeditation.

He reduced Garland’s sentence because of his personal circumstances and his guilty pleas and imposed the seven-year six-month jail term.
