Petrol drive-off offender keeps his licence
A police request for a petrol drive-off offender to lose his driving licence has not been granted.
The request was made in October when Daniel Johnathan Sixtus, 24, and his stepbrother, Daniel Eric Small, 25, pleaded guilty to three drive-off thefts, and stealing a trailer number plate to put on the car.
Small was sentenced last week, getting a sentence of community work, intensive supervision, disqualification, and a reparation payment of $106.
Police had sought disqualification for both of them because a car was used to commit the crimes.
But when Sixtus appeared for sentence in the Christchurch District Court today, disqualification was not seen as an option.
Defence counsel Joseph Mooney explained that Sixtus had been doing well to cope with lengthy terms of community work, but he lived on a rural property and could not cope with the demands of attending community work and supervision if he lost his licence.
He was now trying to get on a Work and Income benefit, and was seeking work and training. His history of convictions for theft was making it difficult to get work.
Judge Paul Kellar said Sixtus had a very favourable pre-sentence report and was motivated to address his offending.
No more community work could be imposed, community detention was not possible because he lived in a caravan, and he decided not to impose disqualification.
He said Sixtus would be treated leniently with a six-month supervision sentence with special conditions, and reparations of $106. “Take this opportunity,” he told the offender.
