Decade in jail for sex assaults on girl
A 47-year-old Christchurch man has been jailed for 10 years 6 months for the sexual abuse of a girl aged about 13.
The girl, now an adult and mother, read her victim impact statement at the Christchurch District Court sentencing of Anthony John Kay.
Kay, self-employed, had denied all charges but was found guilty at a jury trial in October – three guilty verdicts on charges of indecent assault, two of sexual violation, and one of rape.
Crown prosecutor Kathy Basire said the man’s offending had been planned and premeditated.
Defence counsel Trudi Aickin the court should take into account that going to prison for the first time was going to be a heavy burden on a man aged 47. She submitted a non-parole term was not necessary.
Kay continued to deny the offending in his pre-sentencing interview with a probation officer.
Judge Garland said the Crown sought a starting point of 12 years for the offending, but the defence argued for a starting point of seven to eight years for the rape offence.
He said it was offending against a vulnerable victim, because of her age. The sexual violation by rape had been brief because it had caused pain and injury to the victim.
He did not impose a minimum non-parole term as part of the 10 year 6 month jail term.
