Repeat sex offender jailed for threats, breaches

A repeat sex offender has been jailed for 18 months for his third breach of his extended supervision order and for threatening to kill two probation officers.
His sentencing session was told of the “fraught” relationship with probation which still has another seven-and-a-half years to run.
Duane Charles Brendan Paul Burgess claimed at his jury trial in 2006 that he was the victim of an unjust system. He was found guilty of abducting a 14-year-old girl from a Christchurch bus stop for sex, and sexually violating her.
For his fourth sex attack on women and young girls he was sentenced to seven years in prison and since his release he has been subject to a 10-year extended supervision order under which Community Probation monitors him.
Burgess, 41, spoke in the Christchurch District Court today about his dysfunctional relationship with probation as he admitted two breaches of the supervision order in December and threatening to kill two probation officers during a meeting at their Kingslea Street offices on December 2.
Burgess was sentenced immediately because he waived his right to a pre-sentence report – prepared by probation – because of the state of his relationship with the service.
He complained in court of probation staff making up the account of the meeting, and also said he would obey instructions from one probation officer only to find that another officer would breach him for the same conduct.
The breaches this time involved contact with children under 16.
He was jailed for seven months for breaching the order in 2013, and nine months for another breach last year.
Imposing the jail term today, Judge David Saunders told Burgess that if he wanted to change the terms of his extended supervision order he could seek a review before the Parole Board.
Burgess complained that his relationship with probation was “starting to screw up my life”, and yet he faced another seven-and-a-half years of the extended supervision order.
The probation officer in court said: “It’s certainly been a fraught connection.”
