Home detention term for nailgun threat
Home detention has been allowed for a 27-year-old who admitted binding a man to a chair and demanding money while threatening him with a loaded nailgun.
The sentence was imposed on Jesse Rewi Smetham Daniels, the son of radio host James Daniels, in the Christchurch District Court today.
Jesse Daniels had pleaded guilty to charges of demanding with menaces and unlawful possession of a firearm.
The court was told earlier that Daniels had been attending a drug rehabilitation programme.
The police said the incident arose from a dispute over an alleged debt, during which Daniels took a firearm and ammuniton from the victim.
It continued with Daniels contacting two associates who assaulted the victim, and then Daniels contacting some of the victim’s associates while holding a loaded and activated nail gun to his torso and threatening to use it against him.
During the night, Daniels bound the victim to a chair with duct tape. The next morning, he gave the man back his cellphone and he was able to contact a friend who phoned the police.
Judge Gary MacAskill imposed six months of home detention at an address in Sumner, with a special condition for alcohol and drug treatment, and six months of post-detention conditions.
He ordered a $1000 emotional harm reparation payment to the victim.
