Third man admits lies about fatal crash driver

Court House-entranceA third man who prevented a prosecution by his lies to police after a fatal crash on the Otira Gorge has been sentenced to nine months’ home detention.

Kwong Chat Chui, 43, was also ordered to pay $5000 emotional harm reparations to the family of the man killed in the crash, Danian Xu, a 49-year-old chef.

Chui was sentenced by Judge Raoul Neave on the charge of attempting to pervert the course of justice. He had pleaded guilty, but much later than two other men involved in the accident, who were sentenced to home detention last year.

The truck crashed in April 2012, with three people aboard and people travelling in a car behind.

Three men gave the police false statements about who was driving the truck.

When they confessed to the police that another man was driving it was too late to charge him because of a limitation period, and as the truth was not suspected forensic testing was not done at the scene of the accident.

Judge Neave said to Chui: “Investigation and ultimate prosecution of the driving charges was made impossible by your lies and deception.”
