Sex offender in custody for ESO breach
Sex offender Allen Malsen is being held in custody for the latest breach of his extended supervision order by driving a van to make food deliveries.

Defence counsel Judith Walshe today described it as “a reasonably minor breach”, but Christchurch District Court Judge Jane Farish did not agree.
She said it was Malsen’s 10th breach of his extended supervision order, and he had been jailed for 18 months last year for four breaches.
She remanded him in custody for sentencing on March 21.
She told him: “You are a risk of reoffending, hence why you are on an extended supervision order. You are non-compliant with that order. The only penalty is a term of imprisonment.”
Malsen pleaded guilty to the charge of breaching the order.
In 2000, Malsen, then 16 and known as Alan Gilbert Wilson, was denied name suppression when he was sentenced to four years’ jail on 22 sex charges involving four children. Seven charges related to a 2-year-old girl.
Probation said today he was under a 10-year ESO with a condition that he was not to engage in vocational training or employment without the prior written approval of his probation officer.
In January, Malsen went to the 0800-Hungry where he was driving a van to make food deliveries to needy Christchurch families. He had no approval for this work.
Mrs Walshe said Malsen was not a danger. He had only got out of the van once, to have a cigarette, during the deliveries. “He has been prosecuted for this breach because it has become a matter of media interest.”
He had been trying to do a good thing, to help himself, she said.
