Tully will not call evidence in murder trial
Ashburton WINZ shooting accused Russell John Tully has elected not to give evidence or call witnesses in his defence at his trial in the High Court at Christchurch.
The Crown closed his case on Friday afternoon, after seven days of calling evidence from more than 70 witnesses. Today was the eighth day of the trial.
Justice Cameron Mander then asked Tully if he wanted to give evidence or call witnesses, and he replied: “Not without instructing legal counsel.”
The judge told the jury the closing addresses by counsel would be heard on Monday and he would then decide whether to give his summing up on Monday or Tuesday.
Tully, 49, stayed in court for the whole day’s hearing. Earlier appearances in court have led to his removal after he disrupted proceedings by shouting and talking over the judge.
The last police witness gave evidence of items recovered at the arrest scene and in searches along the Ashburton River where police found a bike under a tarpaulin, and a rough campsite. Items included a shotgun wrapped inside a two-man tent, notes about WINZ staff, 37 shotgun shells in a sock, containers, and an empty wallet.
