Man admits ‘buying’ toddler violation video

Christchurch man Matthew Garland Kelly has admitted paying an Auckland woman $300 to send him video of her sexually violating a 15-month-old boy.
A psychiatric report has been ordered for 22-year-old Kelly who has been remanded in custody ahead of his sentencing in the Christchurch District Court set for September 7.
The woman, Krystal Harvey, 23, of Auckland, was originally sentenced in the Manukau District Court to eight months’ home detention and 100 hours of community work, but after an appeal by the Crown, a jail term of three years nine months was imposed.
Name suppression was refused for her on the charge of sexual violation by unlawful sexual connection and making an objectionable publication.
Kelly today pleaded guilty to 16 charges – five of making an objectionable publication, 10 of possession of an objectionable publication, and one of sexual violation by unlawful sexual connection.
Defence counsel Andrew Bailey told the court a disputed facts hearing might be needed before the sentencing could go ahead.
Judge Paul Kellar gave Kelly a first strike warning under the system that imposes heavier penalties on repeat sex offenders.
Crown prosecutor Claire Boshier said Kelly came to police attention after the mother of a girl became concerned about conversations she read on Facebook between her daughter and Kelly.
Police spoke to Kelly at his home on May 9, 2015, and several computers and cellphones were seized to be examined by the police’s Electronic Crime Laboratory.
Objectionable publications including images, videos, and online conversations were found on his cellphone.
Kelly was interviewed and then more inquiries led to more material being found.
An online conversation was found in which Kelly posted images of young children and babies and described in detail the sexual acts he was going to perform on these children.
In August 2014, Kelly was in contact with Harvey and asked her to provide photographs of children wearing nappies and also naked. He encouraged her to make a video of her sexually violating a toddler.
Harvey initially refused, but later made a 64 second video of herself and the baby which clearly showed the sex act taking place. She sent it to Kelly and he paid $300 into her bank account.
Kelly was found in possession of images on his cellphone of women and men in sex acts with naked children, and photographs of naked children. Some charges refer to bestiality images.
Kelly had about 70 images he had taken of himself wearing only a nappy.
