Determined support from mum for son’s bail

Mum came to court to support her son’s application for release on bail…in spite of her recent death.

The man, in his 30s, had been languishing in custody on an assault charge.

Defence counsel Paul Johnson brought an urgent application to the Christchurch District Court for his client’s release on bail on compassionate grounds to attend his mother’s funeral.

She had died two days before.

The case was called before Judge Tom Gilbert.

Mr Johnson explained that the man asked for release from custody for a few days.

He said the man’s father, and whanau, and his mother had come to court to support his bail application.

“Isn’t his mother dead?” Judge Gilbert asked.

Actually, she was in a coffin in the back of a van parked outside the Court House, Mr Johnson explained.

Judge Gilbert granted the application.

The man will drive north with his mum and family, to attend the funeral in Hawkes Bay, and will surrender himself back to prison to continue his remand in custody next week.
