Third man charged over raids on Kaiapoi firm

A third man faces charges of raiding a Kaiapoi firm where the business owner has already been charged with assault and kidnapping after two men were allegedly caught in a ?citizen?s arrest? case.

Marcus Noel Read Cuthbert made an appearance at a Christchurch District Court sitting inside the men?s prison today to face eight new charges.

He had been meant to make an application for release on electronically monitored bail today by defence counsel Shannon-Leigh Litt told Judge Stephen Erber that the application had been abandoned.

He was already facing four charges before today?s appearance where he was remanded in custody to another session at the prison on August 18.

The business owner, David Clemence, 52, of Clemence Drilling in Smith Street, Kaiapoi, has been charged with assault with intent to injure and kidnapping two other men who were allegedly found by staff who believed they had stolen diesel and tools worth $500 from the work site.

Clemence?s defence counsel Geoff Brodie said those charges would be defended on the basis of a ?citizen?s arrest?.

The defence said the two were found and then delivered to the Kaiapoi Police Station where they were charged with burglary and possession of tools for burglary.

Clemence?s case was scheduled to come before a post-committal conference, the next step on its way to a jury trial, at the Maori Land Court building in Christchurch city this week.

Cuthbert, 31 and unemployed,?has now been charged with stealing a cell phone, power tools, a bull bar, tow-bar and wheels worth a total of $15,000 from Clemence on March 16.

He is also charged with unlawfully taking Clemence?s $20,000 vehicle on the same day.

Police have laid four charges against Cuthbert of burglary of earthquake damaged or abandoned homes in Awakura Terrace, Pennyburn Place, and Wilsons Road.

Cuthbert also faces charges of stealing power cable worth up to $3000, and burglary of a storage container in the Cardrona Valley, near Wanaka.

He has not entered any pleas to these charges.
