Pre-trial evidence to be heard in 'citizen's arrest' case

Hearing of oral evidence ahead of a trial has been approved in the case of a Kaiapoi businessman facing charges over a ?citizen?s arrest? case.

The Christchurch District Court sitting at Rangiora heard the legal arguments about the oral evidence application yesterday.

The defence for Clemence Drilling owner Dave Clemence had sought the ruling that would allow the hearing of testimony from the two complainants in the case before it is sent for a jury trial.

Clemence has been charged with the kidnapping and injuring of two men who were allegedly caught by staff stealing from the business? Smith Street site in Kaiapoi.

Police have said the men required treatment for their injuries at the hospital but Clemence said afterwards that he had taken the men to the Kaiapoi police station and could not understand why he had been charged.

Judge Noel Walsh heard the argument and ruled that the hearing of evidence could proceed. The case was remanded to October 4.
