Gang-pad assault charge dropped

Court House-Sept-2013-06Police won’t proceed with a prosecution against a man charged with an alleged bashing at a gang pad in Papanui.

Prosecutor Stephen Burdes told the Christchurch District Court today that police had continued with their investigation but found that potential witnesses had not seen anything or were not in the room at the time.

He told Judge Alistair Garland: “We haven’t got enough evidence to proceed to [a defended hearing] at this time.”

Judge Garland allowed the withdrawal of the charge against Mark Thomas McKersey, 49, who had been charged with assaulting a woman with intent to injure her.

Police said members of the public found a woman distressed and injured on the corner of Main North Road and Vagues Road about 6.30am on June 29. She claimed she had been strangled until she was unconscious at a known gang address nearby.

McKersey was arrested and pleaded not guilty. The case had been remanded to a case review session today to set a date for a defended hearing, before the police decision to drop the charge.
